1. About CareChecked
CareChecked Ltd (“CareChecked”, “we”, “us”, “our”) operates an online marketplace that connects families seeking care with independently verified care providers. CareChecked verifies documentation but does not employ carers or provide care services. All care arrangements are made directly between the family and the provider.
CareChecked Ltd is registered in England and Wales (Company No. 00000000) with its registered office at [Address]. We are registered with the Information Commissioner's Office (ICO) under registration number ZA000000.
2. Acceptance of Terms
By accessing or using the CareChecked website, mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Platform.
3. User Accounts
3.1 Registration
You must provide accurate, current, and complete information during registration and keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
3.2 Account Types
The Platform supports three account types: Family accounts (for individuals seeking care), Provider accounts (for care professionals and agencies), and Admin accounts (for CareChecked staff). Each account type has different rights, obligations, and access levels.
3.3 Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to create an account. Provider accounts are subject to our verification process as described in our How We Verify page.
4. Provider Obligations
4.1 Verification
All providers must complete our verification process, which includes submitting an Enhanced DBS check, proof of identity, professional qualifications, and appropriate insurance documentation. Providers must promptly renew any expiring credentials and notify CareChecked of any changes to their circumstances that may affect their eligibility.
4.2 Subscriptions and Payment
Provider listings are subject to a monthly subscription fee. Providers may not appear in search results or receive enquiries until their subscription is active. Failed payments may result in the suspension of your listing. Full details of our subscription plans are available on our Pricing page.
4.3 Lead Caps
Depending on your subscription tier, you may be subject to a monthly cap on the number of leads (family enquiries or contact reveals) you can receive. Once your cap is reached, your contact details will be temporarily hidden until the next billing cycle or until you upgrade your plan.
4.4 Accuracy of Information
Providers must ensure that all information in their profile, including qualifications, experience, availability, and pricing, is accurate and up to date. Misrepresentation may result in suspension or removal from the Platform.
5. Family Obligations
Families using the Platform must provide accurate information when making enquiries and treat providers with respect. Families are responsible for conducting their own due diligence when selecting a care provider. While CareChecked verifies documentation, we recommend that families also carry out their own checks, including meeting the provider in person before commencing a care arrangement.
6. Platform Rules
6.1 Prohibited Conduct
You must not:
- Use the Platform for any unlawful purpose or in breach of these Terms
- Submit false, misleading, or fraudulent information
- Harass, abuse, or threaten other users
- Attempt to circumvent the Platform to avoid subscription fees or lead caps
- Scrape, copy, or redistribute content from the Platform without permission
- Interfere with the security or integrity of the Platform
6.2 Enforcement
We reserve the right to suspend or terminate any account that breaches these Terms, without prior notice. We may also report suspected criminal activity to the relevant authorities.
7. Limitation of Liability
CareChecked acts solely as a marketplace. We do not employ, recommend, or endorse any care provider. We are not a party to any agreement between a family and a provider. To the fullest extent permitted by law, CareChecked shall not be liable for any loss, damage, or injury arising from the use of care services arranged through the Platform.
Our total liability to you in respect of all losses arising under or in connection with these Terms shall not exceed the amount paid by you to CareChecked in the 12 months preceding the claim.
8. Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is owned by or licensed to CareChecked and is protected by intellectual property laws. You may not reproduce, modify, or distribute any content without our prior written consent.
9. Dispute Resolution
If you have a complaint about another user or the Platform, please follow our Complaints & Escalation process. We will endeavour to resolve disputes fairly and promptly. These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.
